Asbestos Lawsuits and Settlements

If you or someone in your family has been diagnosed with mesothelioma, a cancer caused by exposure to asbestos, you’ve probably spent a lot of money on health care, insurance premiums, and support.

Because almost all asbestos cancer decease cases are caused by negligence on the part of the company that manufactured the asbestos products, many victims file mesothelioma lawsuits against those organizations. If you suffer from an asbestos-caused disease you should contact an experienced lawyer immediately. The purpose of a mesothelioma lawsuit is to recover financial damages resulting from asbestos-related illness.

Steps in Asbestos Cancer Lawsuit

There are several steps in a typical asbestosis/mesothelioma lawsuit:

step 1: Once you've secured the services of a mesothelioma attorney, you must file a lawsuit with the court. Your lawyer will evaluate your records, medical condition, and all other information pertinent to your situation. He or she will then file a petition, or in some states, a complaint or claim. You will be known as the plaintiff, and the organization you are filing against is the defendant.

Step 2: The next step is called "discovery." After filing the lawsuit, legal teams from both sides will exchange documents and information about the case. During this period, you will be asked to answer questions, called interrogatories, both written and on videotape, by the defendant's lawyers. You may be able to do this at home. During discovery you may also give a deposition, or formal interview given under oath, about your family, illness, work history, and treatment.

Step 3: A trial date will be set. At this point, the defendant may offer to settle your mesothelioma case by offering you a specific amount of money. Your lawyer may advise you to wait in hopes of obtaining a better settlement that may happen during the trial.

Step 4: If no settlement agreement is reached, your case will go to trial. If you are in failing health due to your mesothelioma, the trial process could be expedited, but sometimes trials last for several months. Once the case is won, a percentage of the settlement will go to your lawyer. If you don't win, you will not have to pay any fees

Asbestos Class Action Lawsuit

Some people choose to file mesolthelmioma class action lawsuits. This is a lawsuit filed by a group of claimants rather than one individual. Asbestos class action lawsuits are usually filed against corporations that knew the dangers associated with asbestos exposure but still did not tell employees. You may want to participate in an asbestos class action lawsuit, as an out-of-court settlement is more likely when a group of people is involved. But if you file a class action lawsuit you will give up control over the case, because your lawyer will be working on the cases of many other plaintiffs as well.

People typically become involved with a mesothelioma class action lawsuit when they are notified they have been named as part of a group. If you receive this notification, you will be given an overview of the case, and you may decide to opt out. If you opt out, you can do nothing, or you can file your own lawsuit. But if you don't opt out, you will be considered part of the class action lawsuit, and if a settlement is reached, you and everyone else in the group will receive a portion. Out-of-court settlements are more likely when a group of claimants file a lawsuit; there have been several large, successful class action suits brought against manufacturers of asbestos-containing products. If you're trying to avoid a trial, this may be a good solution

If you are a close family member of a person who died of an asbestos-related disease, you may also have the right to seek compensation for your loss. This right is called a "wrongful death" lawsuit. Asbestos Lawsuit Settlements

The purpose of asbestos settlements is to help the victim of asbestos related diseases with money to cover medical expenses. In worse cases, it was meant as a compensation for the loss of income over the years, and the potential earning capacity of an individual.
